What Is The Law Regarding Making A Claim?

The Package Travel Regulations permit you to make a claim against your tour operator, here in the UK, for an illness that you suffered whilst on a foreign holiday. This means that you don’t have to deal with foreign Solicitors and differing laws in claims against hotels in a different country.

If you have booked a package holiday, the tour operator you travelled with is liable for all the services they arranged for you.


What Counts as a “Package Holiday”?

Some tour operators advertise holidays which may appear to be a package on their website or in the shop window, but are actually sold as separate components put together by the travel agency.

A “package” is defined as the pre-arranged combination of at least two of the following components when sold or offered for sale at an inclusive price and when the service covers a period of more than twenty-four hours or includes overnight accommodation:

  • Transport
  • Accommodation
  • Other tourist services not ancillary to transport or accommodation and accounting for a significant proportion of the package

If you are unsure whether your holiday was booked as a package holiday you can check the ATOL certificate provided in your booking documents which will state ‘package sale’. If you are still unsure our team can advise you on whether you are covered by the regulations.


What Does No Win, No Fee Mean?

Is There a Time Limit on Claiming?

Claims like this generally have to be brought within 3 years from the date of the illness. There are however exceptions to this such as cruise ship illnesses and claims on behalf of children.

Anybody under the age of 18 that has suffered an illness on holiday would have 3 years from their 18th birthday to bring a claim. We would require a parent or guardian to act as a ‘litigation friend’ on behalf of the child until their 18th birthday.

What Should I do if I Become Ill?

In order to increase your chances of a successful claim then it is important to gather as much evidence as possible. This includes details and photographs of the food you believe made you ill and any photos of hygiene standards in the facilities you are staying in.

If there are instances of other guests at your resort becoming ill then obtaining names and contact details of those who have been affected, as well as reporting the illness to your rep and tour operator will also help strengthen your case.
